Other Requirements
Applicants who are under 18 years of age who are applying for a visa and travelling with only one parent / legal guardian must provide evidence that both their parents / legal guardians consent to their travel to Australia.
Please provide:
A completed parental consent form (Form 1229) signed by both parents / legal guardians. Form 1229 - Consent to grant an Australian visa to a child under the age of 18 years is available from the department's website at www.border.gov.au/Forms/Documents/1229.pdf
A copy of your birth certificate stating the names of both birth parents.
This should be certified by a Public Notary. If your Birth Certificate is not in English, you should provide an English language translation which has been certified by a Public Notary or by an appropriate person who would normally be authorised to witness the signing of legal documents under the law of your country. Photocopies of the passport bio-data page (the page with the photo and personal information) of the child and both parents / legal guardians
A copy of the page in your parent / legal guardian's passport which displays their signature.
Please note: If your parent / legal guardian's passport does not have a signature, please provide an alternative form of identification which displays their signature.
SOLE CUSTODY
Where only one parent has sole custody of a child under 18 years of age, evidence is also required. To confirm sole custody please provide ONE of the following pieces of additional information:
a certified statement providing details of the sole custody arrangements, including any supporting legislation of the country in which you are residing; or a copy of the legally binding court issued document confirming sole custody, if the parents are separated or divorced; or a copy of the death certificate, if one parent is deceased.
All copies of documents provided to this office must be certified by a Public Notary or by an appropriate person who would normally be authorised to witness the signing of legal documents under the law of the country in which the applicant is residing. Public Notaries can include a Solicitor, Magistrate, Notary Public, Justice of the Peace, Commissioner for Oaths, and Officer of a Court appointed by a Judge to take affidavits.
Translating your documents Documents in languages other than English should be accompanied by an English translation. The English translations must be official certified translations from a National Accreditation Authority for Translators and Interpreters (NAATI) accredited translator. Translations provided by non-accredited translators outside Australia should be endorsed by the translator with their full name, address, telephone number, and details of their qualifications and experience in the language being translated.
Certified copies For the purposes of the migration legislation, a document is to be certified in writing as a true copy of the original document by: if the copy is certified in Australia:
● a Justice of the Peace; or ● a Commissioner for Declarations; or ● a person before whom a statutory declaration may be made under the Statutory Declarations Act 1959 (for example a nurse, legal practitioner, medical practitioner, pharmacist or dentist); or ● a registered migration agent (whose registration is not suspended or subject to a caution). if the copy is certified outside Australia:
● a person who is the equivalent of a Justice of the Peace or Commissioner for Declarations in that place (for example a public notary); or ● a registered migration agent (whose registration is not suspended or subject to a caution)
